De juramentis diversorum Iudicum.


CAP. XVIII.

                                        EST & aliud juramentum Legiferi, sive Iudicis provincialis,
                                        ab XII. viris electi, & a Rege, seu principe confirmati,
                                        tale in forma: Sic peto ego Deum mihi in adjutorem, & hasIuramentS judicis provincialis.
                                        Sanctorum reliquias, quas teneo, quod debeam erga pauperes,
                                        & divites in toto meo legiferatum, in omni judicio justitiam
                                        sequi, & non injustitiam, secundum mensuram conscientiæ
                                        meæ, & cognitionem legum, & nunquam fovere
                                        injustitiam propter timorem, amicitiam, vel cupiditatem
                                        pecuniarum, nec propter invidiam, vel odium, nec propter
consanguinitatem, aut affinitatem, vel amicorum confœderationem. Sic mihi
Deus propitius sit, sicut dico veritatem. Si vero hic, & illi deprehensi fuerint secus,
quam juraverant( accipiendo scilicet munera ) agere, gravi pœna, vel multa puniuntur. Pœna inique indicantium.
Habent enim liberalem, & sufficientem mercedem pro laboribus judiciorum
suorum a communitate, ne justitiam quocunque colore vendant: vt ostendatur apudCommunitas solvit judicibus pro labore.
eos plus valere bonos mores, quam apud alios multimodas, & intricatas leges. Et
revera sic est: eliguntur enim ad hoc opus pium, & justum, ruricolæ bonas possessiones
in domibus, agris, & pascuis habentes, solius naturæ instinctu, bonitate,
& ingenio, ac dotibus præditi: qui citra vllam scientiam, ac literas, sagaciter judicant,
vt appareat e homine nativis bonis excellente, formari potius judicia, &Naturali æquitate rectissimum judicium fit.
præcepta sapientiæ, quam e præceptis sapientiæ formari hominem excellentem.
Ideoque miræ, libertatis, ac nemini, nisi justitiæ, obnoxii existimantur. Jus dictant in
casu perplexo, cum lege scripta, & eis lecta, vt quævis eorum dicta per omnia innitantur
æquitati: meritasque constituunt pœnas, & eas, si opus fuerit, vita & sanguine
(nisi læsæ parti satisfiat)vt executionem habeant, nulla attenta comminatione, Executio censo rarum.
prosequuntur.

De qualitate pœnarum virorum nobilium, vel plebeiorum.

CAP. XIX.

                                        GRAVES tamen casus aliquando incidunt, vt non nisi
                                        Regio tribunali absolvi debeant, aut possint: videlicet
                                        crimen læsæ majestatis, violatio Regiæ securitatis, proditioCrimina læsæ majestatis.
                                        in Rempub. & reliqua similia proditorum, ac transfugarum
                                        facinora: quos quadripartitos integros, vel divisosPœna proditorum.
                                        rotis imponunt, aut gratiosa Principis permissione
                                        gladio truncant: quæ indulgentia solis nobilibus, ob magnificam
                                        originem & stirpem, plerunque concedi solet: nisi
                                        tanta sit atrocitas sceleris, vt omnium acclamatione, &Atrocitas sceleris.
juris rigore, sit suspensione plectendus: quo casu torque argenteo, vel fune sericeo,
& frondoso ligno (ne etiam in mortifero cruciatu cærimoniaæ desint ) suspenditur: Cærimoniæ mortiferaæ.
vbi in arbore putrida, ac vermibus esa, ignominiosum elevari, & consumi reputaretur
