and Article 5. of the same Convention furthér states the obligation of a
neutral power to prevent such an aet from being done on its territory.
3. Having regard to the circumstanees of the case, His Majesty’s
Government are obliged to eonsider the träffic in provisions from Denmark
to German occupied territory in Norway referred to above as coming
within the scope of the term »convoy». Provisions are to all intents and
purposes consigned by the German State authorities in Denmark to similar
authorities in Norway and the tränsaction appears to have no commercial
aspect: the goods are conveyed in German trucks and accompanied by
German personnel. The träff ic has indeed all the appearances of an
or-ganised undertaking aimed at assisting the German campaign in Norway.
His Majesty’s Government therefore hold that it falls under the
prohibi-tion of Article 2. of the Fifth Hague Convention. Accordingly His
Maje-sty’s Government feel it necessary to lodge with the Royal Swedish
Government a strong protest against their action in permitting the passage
of the German train to Narvik and to express the hope that the Royal
Swedish Government do not intend to allow their action in this particular
case to form a precedent in the event of any requests of a similar nature
which they may receive from the German Government.

Utrikesminister Koht kallade mig till sig i dag för att giva uttryck åt
den missräkning och sorg norska regeringen kände över Sveriges
»ovälvilliga- neutralitet» gentemot Norge i dess kamp mot Tyskland. Man hade
här med livligt beklagande måst konstatera, att svenska regeringen vid
fullföljandet av sin strikta neutralitetspolitik intagit en avsevärt snävare
ståndpunkt gentemot Norge än gällande folkrättsliga normer krävde.
Visserligen kunde man förstå, att Sverige icke ansåg sig kunna sälja vapen
och ammunition till Norge i nuvarande läge, men man kände sig desto
djupare desillusionerad över att transitering av vapen och andra
förnödenheter vägrats. Om dessa och andra ting hade man emellertid, sade herr
Koht, gjort framställning genom norska legationen i Stockholm varför
han icke nu ville uppehålla sig mera vid dem.
Vad utrikesministern i dag särskilt tillkallat mig för, var att svenska
rundradion troligen den 24 eller 25 dennes i sin ordinarie
nyhetsutsändning meddelat, först vid ett tillfälle, att norska amiralstaben och därpå
