Any emigrant desirous of increasing tlic liablllty for his baggagc beyond the
’imitation fixed by this contract, for non-delivery of effects npon ar rival at place of
landing in Ainerica or for delay in delivering it or for injnrv thcreto, niay do so by
doclaring the excess valuc of said baggage to the agent of the Cunard Company at the
Port of embarkat.ion and by having the baggagc cntercd in the ship’s manifest and
paying freight, thereon in advance ön the excess valnc declared by him to the Company
at the råte of one perccnt (1 jJ) against a proper bill of lading.
Shonld the emigrant ön arrival in the foreign country lic refnsed by the
autho-ritics to immigrate and, if it cannot be proved liiat this prohibition bas been cansed
by circnmatances coine to pass after this contract was made out, 1 do hcreby agree to
repav the emigrant for the passage and at my expense have him rcturned to
(iothcn-burg, Sweden; likewisc his maintonancc nntil his rcturn and forwarding and care of
his baggage.
Likewisc do I agree if so rcquircd bv the emigrant, to let all controversies ubout
this contracfs explication and the emigrants justice of compensation for
non-fnlllill-"icnt of the same to be decided by five arbiters. of whom the emigrant appoints two,
or in casc I rcfusc, the Kings guvernör in this govcrnmcnt two. and the before said
guvernör the fifth.

Enligt Amerikanska invandringslagen äro följande klasser af främlingar nekade
tillträde till förenta Staterna, nämligen:
l:o) Personer som äro idioter eller sinnesrubbade. 2:o) Personer soln lida af
smittosamma sjukdomar, hvartill numera iifveu räknas tiihcrkclsjukdom såsom lungsot,
den egyptiska ögonsjukdomen (trachoma) m. 11. 3:o) Personer som enligt lag äro
dömda, för vanärande förbrytelser, vittnande om moraliskt forfall. Häri äro dock icke
nibcräknnde åtalade politiska förseelser. 4:o) Personer som gilla månggifte (Mormoner).
a;o) Personer som öfverenskommit om att utföra arbete i Förent» Staterna. ß;o)
Personer soln åtnjuta fattigvård, äro nrbctsodugliga eller i så utblottad!; tillstånd att om
•lem kan förutses att de vid framkomsten till bestämmelseorten falla det allmänna
till last.
I sistnämnda punkt äro äfven inbegripna: Åldrige män och kvinnor, "hvarmed
förstås personer som äro öfver 60 år, krymplingar eller vanskapta. ogift hafvande kvinna,
"Kitt kvinna som medför oäkta barn, samt änkor som medföra minderåriga barn. Men
sådana personer kunna dock möjligen fä landstiga om do inneha bevis från anhöriga
att dessa äro villiga emottaga och försörja dem, dock skall sådant bevis för att äga
Siltighct vara biedigadt inför vederbörande Notarius Publicus i Amerika.»
Huru tvister skola slitas mellan utvandrare och utvandrareagent
angående kontraktets tydning och utvandrares rätt till ersättning
stadgas i Utvandrareförordningens § .r> samt §§ 11 13; och är i §
mom. 2 punkt (! stadgadt att bestämmelserna härom skola finnas
angifna i utvandrarekontrakten. (Jfr härom Bilaga 1. kap. XI).
I kontraktet far ej ingå aftal därom att kostnaden för resa oclt
underhåll skall efter ankomsten till bestämmelseorten genom arbete
aftjänas (§ f> mom. 3). Denna bestämmelse står i
öfverensstämmelse med den amerikanska invandringslagstiftningen, jämlikt hvilken
