92. Till Sir Thomas Cartwright.1

His Excellency Sir Thos. Cartwright etc.

Lest the accompanying document2 should in any future
proceedings be referred to as a legal instrument, I feel called upon to
deposit in your Excellency’s office the following declaration regarding
it, to be made such use of, as circumstances may prove to be
necessary.

I cannot accept that document as genuine: ist because 1 was
never called upon to the Governor’s office with reference to it. On
the 29th March a verbal message by a police officer was delivered
at my house, that the Police Master, Mr. Berg, desired me to call on
him at his own dwelling next morning at nine o’clock. Mr. Edwards
accompanied me, but was not admitted to the private room where
I found Mr. Berg and another gentleman. Certain communications
were indeed made here, verbally, but neither Mr. Berg, nor the other,
noted down a word of what passed, and it never entered my mind
that this was the Governor’s Court, nor was this explained to me,
neither do I believe that even Swedish law would so consider it.
2nd because it is the invariable custom at a second session in the
presence of all the parties to read, correct and confirm the
protocol, which in the meantime has been drawn up of the proceedings
at the first, and should it even be contended that Mr. Bergs private
room was, on the occasion referred to, the Governor’s Court, yet
this indispensable part of the proceedings has been entirely
neglected so far as I am concerned, and I really had no idea, that this
visit to Mr. Berg must be considered as the reply of the Governor
to my memorial. And 3rd because the whole of the last paragraph
containing what purports to be my declaration on the occasion is
totally incorrect. I certainly did at Mr. Berg’s house intimate that
I had no objection to prolong the inhibition as regards the Swedish
service a little longer, but must insist on soon having some
document which would shew where the responsibility of the measure
rested, and I promised not to recommence that Swedish service
without giving previous intimation. But I never did there or
elsewhere express any doubt as to my lawful right to hold Divine
Service in Swedish if I found it expedient so to do.

Mr. Berg, on the occasion now referred to, declared that the
law of 1781 was in force with reference to my services, the Gover-
