707. Mr. Yernon Harcourt.*) I see that
among the Papers you put in on the 2 of July, was
one from the British and Irish Magnetic Telegraph
Co. acceeding to the terms you had offered, but in
that letter is a sentence to this effect: „In so doing
it is right I should draw your attention to the
fact with which you are already acquainted, that
you will as such purchasers have the benefit of
and be subject to the liabilities attaching to an
agreement with the Submarine Telegraph Com
pany." We have not that agreement in extenso,
but is the effect of that agreement between the
Magnetic Telegraph Company and the Subma
rine Telegraph Company, that all the messages
for the Continent collected by the Magnetic Te
legraph Company should be sent by the Subma
rine Telegraph Company? — It is.
708. Then I see further on in your exa
mination, at Question 182, you State: „Our pro
posal necessarily is to acquire the cables belong
ing to the Electric and International Company
as a part of the undertaking of that company.
If we acquire the property of that company we
also derive from thexn their obligations, and we
shall therefore be bound to Mr. Reuter in the
terms of their agreement with)him. Further thau
that, if we acquire the property ot the British
and Irish Magnetic Company we shall be bound
to the Submarine Telegraph Company by the
terms of the agreement between that company
and the British and Irish Magnetic Company."
In your judgment, assuming those different sub
marine companies to remain independent and not
to be purchased, would not there be an incom
patibility on the part of the Post Office, as the
proprietors ot all the telegraphs in England, in
fullfilling those obligations? — Without going so

707. Hr. Yernon Harcourt*). Jeg ser, at
iblandt de Papirer, De indleverede den 2 Juli, var
der et fra British and Irish Magnetic Telegraph Co.,
hvorved det antager de Betingelser, som De havde
tilbudt; men i dette Brev er der en Tirade, saaly
dende; „Idet jeg gjør dette, bør jeg henvende
Deres Opmærksomhed paa den Omstændighed,
hvormed De allerede er bekjendt, at De som
saadan Ejøber vil have Fordelen af og være
underkastet de Forpligtelser, som knytte sig til
en Overenskomst med Submarine Telegraph Co."
Vi have ikke denne Kontrakt in extenso; men gaar
denne Overenskomst imellem Magnetic Telegraph
Co. og Submarine Telegraph Co. ud paa, at alle
Telegrammer til Fastlandet, som indløbe til Mag
netic Telegraph Co., skulde afsendes ved Subma
rine Telegraph Co.? — Det forholder sig saaledes.
708. Endvidere ser jeg, at Dg under Deres
Examination ved Spørgsmaal 132 erklærer: „Yor
Plan er nødvendigvis at erhverve de Kabler, der
tilhøre Electric and Intern. Co.’s Anlæg, Dersom vi
erhverve dette Kompagnies Eiendom, vil ogsaa dets
Forpligtelser gaa fra det over paa os, og vi vil
derfor blive forpligtede til at indgaa paa Betin
gelserne i Sammes Overenskomst med Hr. Reuter.
Endvidere, dersom vi erhverve British and Irish
Magnetic Co.’s Eiendom, ville vi ligeoverfor Subma
rine Telegraph Co. forpligtes ved Yilkaarene i
Overenskomsteu mellem dette Compagni og Bri
tish and Irish Magnetic Co." Vilde det ikke ef
ter Deres Mening, uaar man aotog, at disse for
skjellige submarine Kompagnier forbleve uafhæn
gige og ikke kjøbtes, for Postvæsenet blive ufor
eneligt“med dets Egenskab som Eier af alle
